Grant

According to State Law No. 3.239/1999, waters in the state of Rio de Janeiro, whether surface or underground, can only be used after being granted by the government.  The objective is to guarantee access to water for all users, aiming at the multiple use and preservation of endemic or endangered species of fauna and flora.

 It is incumbent upon the Environmental Licensing Directorate of the State Institute for the Environment (Dilam/Inea) to issue these acts, in accordance with item V of art.  25 of Decree No. 41,628, of January 12, 2009.

The following uses of water resources are subject to the grant:

  • Derivation or abstraction of a portion of water existing in a water body, for consumption;
  • Extraction of water from aquifers;
  • Releases, in water bodies, of sewage and other liquid or gaseous waste, treated or not, with the purpose of its dilution, transport or final disposal;
  • Exploitation of hydroelectric potentials;
  • Other uses that alter the regime, quantity or quality of water in a water body.
The uses that do not depend on granting are:

  • The use of water resources to meet the needs of individuals or small population centers, in rural or urban areas, to meet the basic needs of life;
  • The use of flows and volumes considered insignificant for derivations, captures and launches. Insignificant use does not exempt the respective user from complying with Inea’s resolutions or determinations.
Effluent Releases

According to State Law No. 3.239/1999, art.22, § 2, the grant for industrial purposes will only be granted if the abstraction in water courses takes place downstream of the discharge point of liquid effluents from the installation itself, in accordance with the Constitution State, in its article 261, paragraph 4º.
